after referred to as Mare Owner, hereby request a reservation to the
STALLION,
__________________________________________________________________________REG.#_________________________________
standing at Fancier Farms, Acampo, Ca.
Owner/Manager: Joan DuCray
MARE OWNER, owns/leases the MARE
named__________________________________REG.#_________________________________
MARE OWNER, wishes to breed said MARE to said
STALLION during the ________________season.
1. BREEDING FEE:
$800.00 Solid Mares, $1200 Tobiano Mares. includes a non-refundable booking
fee of $250.00. The Breeding Fee
balance of $550.00 And Equitainer deposit
must be paid in full before semen is shipped. A $110.00 collection and/or
handling fee
will be due before semen is
shipped and all container shipping charges wil be paid by MARE OWNER. Checks
require 10 days
to clear. For your convenience Master
Card and Visa are accepted through
www.paypal.com if you have an email account.
Credit Card or Fed Ex number required
prior to shipment to cover shipping costs.
2.REFUNDABLE DEPOSIT FOR
EQUITAINER: A $300.00 refundable deposit is required to insure
prompt return of Equitainer.
Joan DuCray
agrees to refund total amount of said deposit to MARE OWNER upon return of
Equitainer without damage and all
parts intact. If any parts are missing, cost to replace
parts will be deducted from container deposit. $25.00 per day will be
deducted
from the deposit if said Equitainer is not delivered to
Fancier Farms within 5 days exluding Sunday from the time MARE OWNER
received Equitainer. If MARE OWNER provides FANCIER
FARMS with his/her own Equitainer, the $300.00 is not required.
FANCIER FARMS also has available disposable containers
with a cost of $35.00. Cooled semen can be shipped in this manner.
Frozen Semen cannot.
3.REQUEST FOR SEMEN: Fancier
Farms agrees to provide the MARE OWNER semen when requested(per paragraph
A).
Depending upon availability, at least two insemination
doses will be provided. Semen shipments will be filled in the order they
are received. Shipments will be insured to cover only
Equitainer replacement and collection fee costs. Fancier Farms and Joan
DuCray shall not be held liable for delays in the
delivery of semen or semen that is lost in shipment or mishandled in any
manner
once it leaves the possession of Fancier Farms and
Joan DuCray.
A. It is recommended the
the breeding be done at a Qualified Breeding Facility or under strict
supervision of a
Veterinarian familiar with equine reproduction and shipped semen.
1. Mare must receive a
negative uterine culture before semen is shipped.
2. Fancier Farms must
be notified the day the mare comes into heat.
3.
Fancier Farms must receive request for semen by 4 p.m. PST
the day prior to
shipment.
4. Fancier Farms does
regular collections Monday thru Friday. If Mare OWNER local we are happy
to do weekend
collections.
4.PREGNANCY CHECK: MARE OWNER
agrees to have the MARE examined by an early ultrasound scan between 14 and
18 days from the last day inseminated and notify
Fancier Farms and/or Joan DuCray of pregnancy status. It is recommended
that MARE be pregnancy checked again at 45 days.
5.LIVE FOAL GUARANTEE: If the
mare does not settle or produce a "live foal" (one that stands and nurses or
is hand fed for a
period of 72 hours, Joan DuCray agrees to rebreed the
same MARE or approved substitute the following year on the terms and
conditions provided in this contract without payment
of any breeding fee. It is agreed that this provision will no longer be in
effect
if the MARE is taken to any other STALLION before
returning to the above-named STALLION. The live foal guarantee is valid,
only
with verification from, signed
and dated a licensed veterinarian on his practice stationary.
6.REGISTRATION OF FOAL: Joan
DuCray agrees to execute all necessary documents for the registration of the
foal resulting
from the breeding. Joan DuCray will not be responsible
for registration or DNA testing fees for the foal.
7.TERMINATION: Either party may
terminate this Contract for failure of other party to meet any terms of this
contract. In the case
of any default by one party, the wronged party shall
have the right to recover reasonable attorney's fees and court costs as a
result of said default. If the STALLION should die,
become unfit for service, be sold, or leased, there is FROZEN SEMEN
available. If no substitue is available and breeding
fee paid will be refunded. Any collection or shipping fees are not
refundable.
If MARE dies or becomes unfit to breed before
producing a live foal, then MARE OWNER may substitute another MARE.
8.CONTACT IN FORCE: A photo copy
of MARE'S registration papers (both sides) must be returned with this
contract. When
Joan DuCray signs, dates and returns a copy of this
contract to MARE OWNER, it will become the binding contract of both parties.
This contract is not transferable or assignable by
either party hereto without the expressed written consent of the other. In
the event
the MARE is sold or otherwise disposed of prior to
the birth of the foal the "Live Foal Guarantee" will no longer be valid
unless
specific written consent or assignment is given to
MARE OWNER prior to transfer of ownership.

authority to enter into this contract on behalf of the owner(s)
